Conditions of Acceptance
The acceptance, shipment, or delivery of any order is conditional upon approval of LONGEVITY ACRYLICS credit department and upon these sales terms and conditions applying to the order and not any others, unless specifically agreed to in writing by LONGEVITY ACRYLICS INC. If a customer is unable to receive the product when delivery is due, then the price and delivery date are subject to change.
Prices
Orders are accepted subject to prices in effect at the time of the shipment of a price list, and prices are subject to change without notice. All prices shown are the manufacturer’s suggested list prices in CAD ($) and are subject to a trade discount as determined by Longevity Acrylics Inc. Orders will be invoiced at the price in effect at the time the orders are placed. Selling prices may be readjusted during the year without notice if, for instance, transportation (or other) costs increase due to fuel surcharges or other unforeseeable changes.
Damage
LONGEVITY ACRYLICS is not responsible for shipping damage. Damage occurring in transit is the responsibility of the carrier. The product should be carefully examined by the user or installer at the time of receipt to ensure it is damage-free. If any damage is discovered, it should be noted on the freight bill, and a claim should be filed against the carrier as soon as possible.
Inspection of the unit prior to installation is the responsibility of the installer or building contractor who acts on behalf of the user, or the user himself. They are responsible for ensuring that the unit is free of defect or damage. In the event of a problem, the unit must not be installed. LONGEVITY ACRYLICS is not responsible for failures, costs, damages, or claims that could have been discovered, repaired, or avoided by proper inspection and testing prior to installation.
If, upon receipt, the recipient notices that certain products are missing, he must immediately notify our customer service department. The recipient must then indicate which products are missing on the delivery slip and countersign it. The enclosed bill of lading allows you to verify shipped and received merchandise.
Discontinued / Changed Models / Specifications / Colour Variations
LONGEVITY ACRYLICS reserves the right to discontinue products at any time or change specifications and/or design without notice and without incurring obligation. All dimensions are approximate and subject to change without notice. Available colors are subject to change, and varying textures and patterns may be present in the final bathware product. The purchaser may not use such differences to obtain a price discount or to cancel the order.
Cancellation
Orders must be cancelled within 24 hours of receipt of LONGEVITY ACRYLICS confirmation. All cancellation requests must be made by email to [email protected] and be confirmed by LONGEVITY ACRYLICS.
Maintenance
If using a household cleaner, make sure it is recommended for use on acrylic by the manufacturer. Be sure to read the label and follow the cleanser’s recommendations. Never use abrasive cleaners.
Do not allow your Longevity bathware surface to come into contact with products such as ketones or esters such as acetone or ethyl acetate (nail polish remover), Wintergreen oil (methyl salicylate), nail polish, dry cleaning solution, or other chlorinated organic solvents, lacquer thinners, gasoline, aromatic solvents, pine oil, etc.
Remove dust and dry dirt with a soft, damp cloth. Clean grease, oil, paint, and ink stains with isopropyl (rubbing) alcohol. Dry with a clean, soft cloth.
Avoid using razor blades or other sharp instruments that might scratch the surface. Small scratches can be removed by applying a thin coat of automotive paste wax and buff lightly with a clean cloth.
If you use a rubber or plastic anti-skid mat, make sure to remove it after every shower to avoid harming the surface finish.
Limited Warranty
LONGEVITY ACRYLICS offers the following express limited warranties on its products. These warranties extend only to the original owner/end-user for personal household use and start from the manufacturing date of the unit. For commercial uses, additional limitations apply.
This warranty does not apply to products or equipment not installed or operated in accordance with instructions supplied by LONGEVITY ACRYLICS and all applicable rules, regulations, and legislation pertaining to such installations.
LONGEVITY ACRYLICS warrants all of its Products to be of good quality and to be free of defects in material and workmanship for the applicable limitation periods set out below and will, at its sole option, repair or replace any defective product upon prompt notification to LONGEVITY ACRYLICS and examination by a representative of LONGEVITY ACRYLICS. This warranty will not apply to Products which have been altered in any way.
LONGEVITY ACRYLICS warrants its acrylic bathtubs, showers, and tubshower units to be free from defects in workmanship and materials under normal use and service for a LIFETIME from the initial date of purchase by the original owner/end-user.
LONGEVITY ACRYLICS warrants its grab bars, handrails, and shower rods to be free from defects in workmanship and materials under normal use and service for a period of two (2) years from the initial date of purchase by the owner/end-user.
LONGEVITY ACRYLICS warrants its shower doors to be free from defects in workmanship and materials under normal use and service for a period of ten (10) years from the initial date of purchase by the owner/end-user.
LONGEVITY ACRYLICS warrants its acrylic shower bases to be free from defects in workmanship and materials under normal use and service for a period of ten (10) years from the initial date of purchase by the owner/end-user.
The warranty period for products installed for commercial applications or used in commercial ventures is of three (3) years from the initial date of purchase by the owner/end-user, contractor, or builder from an authorized dealer.
Any product reported to the authorized dealer or to LONGEVITY ACRYLICS as being defective within the warranty period will be repaired or replaced (with a product of equal value) at the option of LONGEVITY ACRYLICS. Costs for freight associated with shipping of replacement product/parts might be charged to the customer. In no event will LONGEVITY ACRYLICS be liable for the cost of repair or replacement of any installation materials, including but not limited to, tiles, marble, drywall, molding, etc. This warranty extends to the original owner/end-user and is not transferable to a subsequent owner.
LONGEVITY ACRYLICS reserves the right to modify this warranty at any time, it being understood that such modification will not alter the warranty conditions applicable at the time of the sale of the products in question.
This warranty is in lieu of all others express or implied by operation of law or otherwise and may not be extended by LONGEVITY ACRYLICS representatives, agents, employees, or associates or by written sales information or drawings.
This warranty shall not apply following incorrect operating procedures, breakage, or damages caused by normal wear and tear, fault, carelessness, abuse, misuse, misapplication, improper maintenance, alteration, or modification of the unit, as well as chemical or natural corrosion, accident, fire, flood, act of God, or any other casualty. This warranty shall not apply to stain or malfunction caused by ferrous water, hard water, or salty water.
LONGEVITY ACRYLICS strongly recommends that its products—for example, but without limitation, shower doors and other items—be installed by professionals with experience in bathroom products. Installation of shower doors by an inexperienced person may result in glass breakage and, consequently, cause personal injury.
LONGEVITY ACRYLICS is not liable for any costs, damages, or claims resulting from the purchase of products that do not fit through openings or existing structures. LONGEVITY ACRYLICS is not liable for any costs, damages, or claims resulting from defects that could have been discovered, repaired, or avoided by inspection and testing prior to installation.
LONGEVITY ACRYLICS is not liable for personal injuries to any person or for any direct, special, incidental, or consequential damage, loss of use, loss of time, loss of profits, inconvenience, incidental expenses, labor, or material charges, or any other costs resulting from the use of its products or pertaining to the application of the present warranty, or resulting from the removal or replacement of any product or element or part covered by this warranty.
If there is any dispute between the parties regarding product specifications, conformity to specifications, requested changes to products (whether to dimensions, color, tolerance, clearance, finishing, or otherwise) or the need to make changes to products, we may suspend or delay delivery of the products while such a dispute is being resolved in good faith by the parties. In the event that such a dispute cannot be resolved by the parties, we reserve the right to cancel the order and provide a refund to you for any undelivered products.
Except as otherwise provided above, LONGEVITY ACRYLICS makes no warranties, express or implied, including warranties of merchantability and fitness for a particular purpose or compliance with any code.
Limitation of Actions and Liability. You agree that all your claims arising in connection with our sale of products to you will only be valid for one (1) year from the date of your purchase.
This paragraph states your sole and exclusive remedies. We will not be liable for any loss, damage, or injury resulting from the delay in delivery of the products or for any failure to perform which is due to circumstances beyond our control or the control of our suppliers, including without limitation failure or delay in transportation, acts of any government or any agency or subdivision thereof, judicial action, labor disputes, fire, accident, acts of nature, shortage of labor, fuel, or raw material, or machinery or technical failure. Our maximum liability, if any, for all damages, including without limitation contract damages and damages for injuries to persons or property, whether arising from our breach of any contract or agreement, breach of warranty, negligence, strict liability, or other tort with respect to the products, is limited to an amount not to exceed the then-current wholesale price of the products. In no event will we be liable to you for any incidental, consequential, or special damages, including without limitation lost revenues and profits, even if we have been advised of the possibility of such damages. Your right to recover damages within the limitations specified in this paragraph is your exclusive remedy.
Force Majeure. We will not be liable or responsible to you, nor be deemed to have defaulted or breached any agreement, purchase order, confirmation, or quotation (each, an “agreement”), for any failure or delay in fulfilling or performing any term of any agreement when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control including, without limitation, as to us and our facilities and products and the facilities, materials, and products of our suppliers, acts of God, flood, fire, earthquake, explosion, orders, directions, or actions of any public authority, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, pandemic, lockouts, labor shortages, strikes, or other labor disputes (whether or not relating to either party’s workforce), restraints or delays affecting carriers, inability or delay in obtaining supplies of adequate or suitable materials, components, or services, telecommunication breakdown or power outage, shortage or failure (all such circumstances collectively, “Force Majeure Events”). We may change the pricing applicable to any of our products or goods and terminate any agreement with immediate effect in case of any Force Majeure Event that continues for 5 days or more. During any such delay or failure to perform, our obligations will be suspended, and we will not have any obligation to provide you with the products or goods from other sources or to pay or reimburse you for any additional costs to you of obtaining substitute products or goods. We may, during any period of shortage due to any of the above circumstances, allocate our available supply of products or goods among our customers in any manner that we deem fair and reasonable in our sole discretion.
